Ombudsman Powers

The Ombudsman has the power to investigate any action of the agency during the review, by exercising the powers of a Royal Commission.

Ombudsman SA is able to attempt to reach a settlement between the parties at any stage of the review.

If the determination by the agency or council was made on or after 1 January 2005, the Ombudsman may confirm, vary or reverse the determination the subject of the review (rather than directing the agency or council to revise its decision).

The agency is able to appeal to the District Court against the determination of the Ombudsman, but only on a question of law.
