Investigation into Cr Darren Kruse’s failure to act with reasonable care and diligence in the performance of his official functions and duties by failing to respond to Ombudsman SA enquiries and investigation.
The Ombudsman has published a final investigation report concerning the conduct of Cr Darren Kruse of the City of Mitcham.
In the course of assessing and then investigating allegations that Cr Kruse had failed to comply with the conflict of interest provisions of the Local Government Act 1999, the Ombudsman sought responses from Cr Kruse on multiple occasions including by way of statutory notice. Cr Kruse repeatedly failed to respond to those communications. Ultimately the Ombudsman determined that it was not in the public interest to continue her investigation into the conflict of interest allegations. However, she determined that Cr Kruse’s failure to respond to her enquiries amounted to a breach of Cr Kruse’s obligations to act with reasonable care and diligence in the performance of his official functions and duties under the Local Government Act.
The Ombudsman recommended that the council reprimand Cr Kruse.
